Terms of Use

1. General provisions

1.1. These Terms of Use (hereinafter — the Terms) govern the relationship between 2Medlink Group LLP, BIN 260740001075, Republic of Kazakhstan, Almaty, 37 Abay Ave. (hereinafter — the Company, "we"), and any person using the iBolid.kz online portal on the ibolid.kz and mag.ibolid.kz domains (hereinafter — the Portal, and such a person — the User).

1.2. The Terms are a public offer. Beginning to use the Portal — viewing pages, searching, registering, arranging an appointment booking or an order — means full and unconditional acceptance of the Terms.

1.3. If the User does not agree with any provision of the Terms, they must stop using the Portal.

1.4. The processing of personal data is governed by the Privacy Policy, which is an integral part of the Terms.

2. What iBolid.kz is

2.1. The Portal is an information service. It provides the User with:

• catalogs of doctors, clinics, pharmacies and medicines with search and filtering;
• the ability to arrange an appointment booking with a doctor at a chosen clinic;
• the ability to reserve or order medicines at a pharmacy;
• a personal account with a history of bookings and orders, favorites and notifications;
• user reviews of doctors, clinics and pharmacies;
• a scientific and information section for medical professionals at mag.ibolid.kz, including continuing medical education materials.

2.2. The Company is not a medical organization and does not provide medical care. The Company does not make diagnoses, does not prescribe treatment, does not issue medical opinions and does not dispense medicines.

2.3. Medical services are provided by the clinic or doctor with whom the User has booked an appointment; medicines are dispensed by the pharmacy. The party to the contract for the provision of medical services and to the retail purchase and sale contract for medicines is the relevant partner, not the Company.

2.4. Information on the Portal, including descriptions of medicines, articles and search results, is for reference only, does not constitute a medical consultation or advertising of medicines, and does not replace an in-person visit to a specialist. Before using any medicine, you must consult a doctor and read the manufacturer's instructions.

2.5. Use of the Portal is free for a patient User. The Company does not accept payment from the User for medical services and medicines: settlements are made directly with the clinic or pharmacy.

3. Registration and account

3.1. Some Portal features (appointment booking, ordering medicines, favorites, reviews) are available only to registered Users.

3.2. Registration is carried out using a mobile phone number with confirmation by a one-time code. A permanent password is not used. On first registration, the User provides a first and last name and confirms consent to the processing of personal data.

3.3. Persons who have reached the age of eighteen have the right to register. Legal representatives act on behalf of minors.

3.4. The User undertakes to provide accurate data and to keep it up to date.

3.5. The User is solely responsible for maintaining access to their phone number and device. All actions performed using their account are deemed to have been performed by them until they have notified us otherwise at info@ibolid.kz.

3.6. One natural person has the right to have one User account. Accounts for doctors, clinics, pharmacies and manufacturers are created separately and undergo verification.

4. Appointment booking

4.1. By arranging a booking, the User sends the clinic a request for an appointment at the chosen time. The Company forwards the request to the clinic and notifies the User of its status.

4.2. A booking is deemed confirmed after confirmation by the clinic. The clinic has the right to decline or reschedule a booking, including where the doctor's schedule changes.

4.3. The availability of appointment times, prices, and doctors' specialization and qualifications are displayed on the Portal based on the data provided by partners. The Company takes reasonable measures to keep this data current but does not guarantee the absence of discrepancies and recommends verifying material terms directly with the clinic.

4.4. The User has the right to cancel an upcoming booking in the personal account. The User undertakes to cancel a booking in a timely manner if the appointment will not take place.

4.5. Systematic no-shows without cancellation may result in a restriction of the ability to book online for the corresponding account.

4.6. The Company is not responsible for the quality, scope, timing and outcome of the medical services provided, or for a clinic's or doctor's refusal to provide them. Claims regarding medical services are made to the medical organization.

5. Ordering and reserving medicines

5.1. Placing an order means reserving medicines at the chosen pharmacy for pickup, or arranging delivery if the pharmacy offers it.

5.2. The availability, price and dispensing conditions of medicines are determined by the pharmacy. Information about availability and prices on the Portal is for reference only and may differ from the actual position.

5.3. Payment is made at the pharmacy or on receipt of the order. The Company does not accept payments and is not a seller of medicines.

5.4. Prescription-only medicines are dispensed by the pharmacy only upon presentation of a prescription issued in the prescribed manner. Placing an order through the Portal does not replace a prescription.

6. Reviews and user content

6.1. The User has the right to leave reviews about a doctor, clinic or pharmacy. A review of an appointment may be left once for each completed visit.

6.2. A review must be based on the User's personal experience. It is prohibited to post:

• knowingly false information, as well as information that defames the honor, dignity and business reputation of others;
• insults, threats, profanity, incitement of hatred;
• personal data of third parties without their consent, including information about their health;
• advertising, spam, links to external commercial resources;
• information whose distribution is prohibited by the legislation of the Republic of Kazakhstan.

6.3. Reviews are subject to moderation. The Company has the right to decline, hide or delete a review that violates clause 6.2, and to suspend publication of a review while a partner's complaint is being examined.

6.4. A partner has the right to publish a reply to a review.

6.5. By posting a review, photo or other material, the User confirms that they hold the rights necessary for it and grants the Company a free-of-charge non-exclusive right to use this material on the Portal and in the Portal's information materials without limitation of period or territory.

6.6. The Company is not obliged to pre-screen user content and is not responsible for the content of reviews that reflect the subjective opinion of their authors.

7. Rights to the Portal's content

7.1. The Portal, its software code, design, structure, texts, images and databases are protected by copyright and related rights legislation.

7.2. Without the Company's written consent, it is prohibited to copy, reproduce, adapt and distribute the Portal's materials, except for fair quotation with an indication of the source and an active link.

8. Restrictions on use of the Portal

The User is prohibited from:

• automated collection of Portal data (parsing, crawling, copying catalogs) without the Company's written permission;
• creating an excessive load on the Portal, attempting to circumvent request rate limits and to guess confirmation codes;
• attempting to gain unauthorized access to accounts, other users' data and internal sections;
• using the Portal to send spam and advertising;
• registering on behalf of another person without their authorization, and creating fictitious accounts for clinics, pharmacies and doctors;
• any other use of the Portal that violates the legislation of the Republic of Kazakhstan or harms the Company, partners or users.

9. Doctor and partner accounts

9.1. Doctors, clinics, pharmacies and manufacturers gain access to specialized cabinets after verification. A diploma, certificates, license number and other documents may be requested for verification.

9.2. A partner warrants the accuracy of the information posted — about specialization, qualifications, licenses, services, prices and schedule — and bears independent responsibility for it.

9.3. The Company has the right to refuse verification, and to suspend or terminate access to a cabinet, if inaccurate information is discovered or the Terms or legal requirements are violated.

9.4. A partner undertakes to process the personal data of patients obtained through the Portal in accordance with the legislation of the Republic of Kazakhstan and to use it solely to provide the requested service.

9.5. The commercial terms of cooperation with medical organizations are determined by the Offer for Partners and (or) a separate contract.

10. Notifications

10.1. The Company sends the User service notifications related to their bookings and orders: creation, confirmation, appointment reminder, cancellation. Such notifications are not advertising and cannot be disabled without opting out of the corresponding Portal feature.

10.2. Notifications are sent to the personal account and, where technically possible, to WhatsApp at the number provided during registration.

10.3. Advertising and information mailings are sent only where separate consent has been given. You can opt out of them at any time.

11. Liability

11.1. The Portal is provided "as is". The Company does not guarantee uninterrupted and error-free operation of the Portal, the availability of individual features or the preservation of user content in the event of technical failures, but takes reasonable measures to prevent them.

11.2. The Company is not responsible for:

• the acts and omissions of clinics, doctors, pharmacies and manufacturers, including the quality of medical services and medicines;
• the accuracy of information posted by partners and users;
• decisions made by the User on the basis of the Portal's reference information, including self-medication;
• the inability to use the Portal for reasons beyond the Company's control, including communication and User equipment failures;
• losses arising from the User's violation of the Terms.

11.3. The limitations of liability apply to the extent permitted by the legislation of the Republic of Kazakhstan and do not affect the consumer rights established by law.

12. Suspension and termination of access

12.1. The Company has the right to restrict or block access to an account in the event of a violation of the Terms, a reasonable suspicion of unlawful actions, or at the request of an authorized body, having notified the User if this does not contradict the law.

12.2. The User has the right to stop using the Portal at any time and to demand deletion of the account by sending a request to info@ibolid.kz.

12.3. Termination of access does not release the parties from obligations that arose before such termination.

13. Amendment of the Terms

13.1. The Company has the right to amend the Terms unilaterally. A new version takes effect from the moment it is posted on the Portal.

13.2. Continued use of the Portal after a new version takes effect means agreement with it. If the User does not agree, they must stop using the Portal.

14. Governing law and dispute resolution

14.1. The Terms are governed by the law of the Republic of Kazakhstan.

14.2. The parties take measures to resolve disputes out of court. A claim is sent to info@ibolid.kz; the period for its consideration is thirty calendar days from the date of receipt.

14.3. Disputes not resolved out of court are subject to consideration by a court at the Company's location, unless a different jurisdiction is established by mandatory rules of law, including consumer protection law.
